Other than Hindus, Sikhs, Jains and Buddhists can also form a HUF. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The roots of HUF go back into the Hindu Law. It consists of males of a\nfamily lineally descending from a common ancestor. The members of the family\nare not restricted just to sons but also includes unmarried daughters and the\nspouses of the sons. Because of its unique nature, the HUF\u2019s relations merge\nfrom the status and not from any legal contracts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Though HUF is automatically created at the time of marriage but businessmen\nuse it for saving taxes and because of lesser requirements for compliance that\nhelp them with smoother working. Another important thing to note here is that a\nHUF is taxed separately from the members of HUF.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Prerequisites to Form HUF<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Compliance with the understated requirements is must in order to have a\nHUF:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Name<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It should have a name because HUF is a separate entity, it should have\na name.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Capital<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ancestral property, assets received through will, assets gifted by\nfriends or relatives can be used to form HUF because capital is an important\nprerequisite for setting up any business entity.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Members and Their Religion<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Only a Hindu, Jain, Sikh or Buddhist married couple can form a HUF\nwhose child or children will be integrated into it after the birth. There is a\nKarta (the male head with decision making responsibility), coparceners (who are\nentitled to share of property) and members. On death of sole male member in the\nfamily, the existing female members will continue with functioning of HUF. And\nan adopted child can become a member but not a coparcener.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>HUF Deed<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Formation of HUF doesn\u2019t depend upon a legal deed but having a deed is\na legal proof that the entity exists. It should include a declaration by family\nmember along with name and authority of Karta, capital invested in forming HUF\netc.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Separate PAN and Bank Account<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Under Form 49A, application for PAN for HUF can be submitted. This\nrequires HUF deed and is important for financial transactions, filing ITRs and\nclaiming deductions. PAN and ITRs have signatures of Karta.
